A plan that includes data is required with all smart phones. You may be billed additional Charges or fees for certain features and services such as
operator or directory assistance and content downloads. Your first bill may be higher than normal due to proration – charges for the time the service went into effect until the end of the billing period, plus your
normal charges for service for the next month. Your minutes may also be prorated. Immix Wireless does
not guarantee coverage. You may terminate Service at any time. If you have a fixed term agreement,
you will be subject to an Early Termination Fee if you terminate Service before the end of your commitment. Immix Wireless data services and your handset may allow you to access the internet, text, pictures, videos, games, graphics, music, email, sound, and other material (“data content”) or send Data Content elsewhere. Some data is available from us or our vendors, while other data and content can be accessed from others (third party web sites, games, ringtones, etc). Immix Wireless makes absolutely no guarantees about the data content you access on your devices. You cannot use Immix Wireless data service with service devices or host computer applications, or other systems that drive continuous heavy traffic or data sessions, and you cannot use as a substitute or backup for private lines or frame relay connections. If your services include unlimited web or data access, you also cannot use your device as a modem for computer or other equipment. We may suspend or terminate your service or agreement if you live in an area where we don’t provide Service or more than 50% of your voice and/or data usage is off-network for any three consecutive billing cycles.
